The United States Department of Education’s Office for Civil Rights (OCR) released new regulations under Title IX effective August 14, 2020. All materials used to train Title IX Coordinators, investigators and decision-makers must be publicly available.
Each academic year, Montclair State University requires all faculty and staff to complete online Title IX training. Ongoing gender-based misconduct prevention training is required under Title IX of the Education Amendments Act of 1972 and the Campus Sexual Violence Elimination Act (“Campus SaVE Act”), which is part of the Violence Against Women Reauthorization Act of 2013. The training has been revised to conform to the new federal regulations adopted in 2020 and codified at 34 C.F.R. 106.
1-Course: 2020 Title IX Regulations: Policy Implications and Practical Application
The new Title IX regulations have been released, and the expert Title IX team at NACCOP and DSA (D. Stafford & Associates) have developed a live class (12 hours of instruction) to guide practitioners through the new regulations and help them understand the institutional and operational impacts. The NACCOP/DSA team, comprised of seasoned practitioners, has analyzed the changes and is poised to help attendees understand the implications to their existing Title IX Sexual Misconduct Policies and how to practically apply the new regulations through both a Title IX and Clery/VAWA lens. These live, virtual classes will use technology to facilitate the presentation of the course material and small group exercises to enhance learning through active participation. Topics will include an overview of the requirements, hearing process; selection and training of decision-makers; in-person vs. virtual hearings; building and facilitating a hearing agenda; managing hearing participants; considerations in selecting institutional advisors; bias, questioning, and cross-examination; evaluating relevant evidence; making a finding; specific considerations regarding employee cases; and the appeal process.
2-Course: Title IX Coordinator and Investigator Training
The training is two three-hour sessions on Wednesday, July 8th: morning and afternoon. The morning session will be given by Jeff Nolan, Senior Counsel, Holland & Knight LLP, and run from 9:30 a.m. – 12:30 p.m. The afternoon session will be given by Chantelle Cleary, Senior Title IX Consultant, Grand River Solutions, and run from 1:30 -4:30 p.m. They will cover what investigators need to know about their obligations under the new Title IX regulations, addressing the training requirements for investigators that are outlined in the regulations, and trauma-informed investigation approaches in a manner that is fair and impartial, as required by the new regulations. Chantelle Cleary will cover best practices in conducting Title IX Hearings that are fair, impartial, thorough, and compliant with state and federal requirements, including the final Title IX regulations. She will cover the critical role of the hearing chair, advisor examination/cross-examination, and evidentiary considerations.
